Three Categories of PFAS Claims

The Forever Justice Alliance℠ pursues PFAS-related claims across three primary categories. Here’s what each looks like and the kind of clients you should be referring.

Public Water Systems (PWS)

Who: Municipalities, rural water associations, and other public water providers facing PFAS contamination or the threat of contamination.

Potential damages:

  • Remediation and treatment infrastructure costs
  • Ongoing monitoring and testing expenses
  • Filtration system installation and operation
  • System replacement where remediation is not feasible
  • Strategic communications and crisis response

Fee structure: 25% contingency fee on PWS claims.

Farmers, Landowners, and Water Wells (FLOWW)

Who:

  • Farmers and ranchers (row crops, livestock, etc.)
  • Private well owners
  • Landowners in close proximity of known contamination
  • Transient Non-Community Water Systems (truck stops, parks, campgrounds, hotels, restaurants)
  • Non-Transient Non-Community Water Systems (schools, factories, mobile home parks)

Potential damages:

  • Water and soil contamination
  • Property value diminution
  • Crop or livestock impacts
  • Biosolids/sewage sludge contamination of farmland
  • Treatment and remediation costs for private systems

Fee structure: 40% contingency fee on FLOWW claims.

Individual Personal Injury (IPI)

Who: Clients diagnosed after January 1, 2000 with any of the following conditions linked to PFAS exposure:

  • Kidney Cancer
  • Liver Cancer
  • Testicular Cancer
  • Thyroid Cancer
  • Thyroid Disease
  • Ulcerative Colitis
  • Bladder Cancer
  • High Cholesterol
  • Pregnancy-Induced Hypertension
  • Pancreatic Cancer
  • Breast Cancer
  • Leukemia
  • Non-Hodgkin’s Lymphoma
  • Prostate Cancer

Exposure pathways: Contaminated drinking water (public or private), workplace exposure (firefighters, chemical plants, manufacturing), consumer products.

Fee structure: 40% contingency fee on IPI claims.

How to Identify These Clients in Your Practice

Watch for opportunities in your existing client base:

  • Personal injury clients with one of the listed cancers
  • Family law clients whose loved one died of cancer
  • Estate or probate clients with cancer in the family
  • Business or real estate clients with rural property or wells
